Assault

Victims of physical assault can pursue civil damages in addition to any criminal charges filed against the attacker.

Assault

Assault under Texas Law is when an individual intentionally, knowingly, or recklessly causes or threatens bodily injury to another.

Additionally if a person makes an offensive or harmful physical contact with another this is classified as assault.

Depending on the offense and the people involved, the assault can be classified anywhere from a misdemeanor to a felony. Which means that in certain cases, a small fine and jail time might be the punishment rendered by the court, but in other cases, punitive damages are available. Punitive damages are available when the assault is so shocking that the court feels that a large sum of money should be paid out to the victim.
